Eighty Six Brand, LLC (“Eighty Six,” “we,” “us”) operates this store and website, including all related information, content, features, tools, products and services (the “Services”). The Services are powered by Shopify. This Privacy Policy describes how we collect, use and disclose your personal information when you visit, use or buy from the Services, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls for the collection, processing and disclosure of your personal information.
Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have read and understand it.
Personal Information We Collect or Process
“Personal information” means information that identifies, or can reasonably be linked to, you or another person. It does not include information that is collected anonymously or that has been de-identified. Depending on how you use the Services and where you live, we may collect or process the following, including inferences drawn from it:
- Contact details: name, billing and shipping address, phone number and email address.
- Age verification information: your date of birth and, if you can’t be verified automatically, a photo of your government-issued ID, plus the result of the verification.
- Financial information: payment card details, transaction details, form of payment and payment confirmation. Card details are handled by our payment processor and are not stored by us.
- Account information: username, password, preferences and settings.
- Transaction information: items you view, add to your cart, purchase, subscribe to, return, skip, pause or cancel, and your past orders.
- Subscription information: products in your plan, delivery frequency, billing schedule, subscription status and portal activity.
- Rewards information: points earned and redeemed, reward tier and referral activity.
- Reviews: reviews, ratings and photos you submit, with the name you provide.
- Communications: information you send us, for example in a support email or a contact or wholesale form.
- Device information: your device, browser and network connection, IP address and other unique identifiers.
- Usage information: how and when you interact with and navigate the Services.
Where We Get Personal Information
- Directly from you: when you create an account, place an order, sign up for emails or texts, verify your age, write a review or contact us.
- Automatically: from your device when you use the Services, including through cookies and similar technologies.
- From our service providers: when they collect or process information for us.
- From partners or other third parties.
How We Use Your Personal Information
- Provide, tailor and improve the Services: to process payments, fulfill and ship orders, manage subscriptions and rewards, handle returns and replacements, manage your account, post reviews, send account and order notices, and recommend products.
- Age verification and legal compliance: to confirm you are 21 or older before we ship, and to avoid shipping to places where we can’t deliver a product. We use age verification information only for this purpose.
- Marketing and advertising: to send marketing by email or text message (with your consent where required) and to show you online ads, including ads based on items you’ve viewed, added to your cart or purchased.
- Security and fraud prevention: to authenticate your account, secure payments and detect, investigate or act on fraudulent, illegal, unsafe or malicious activity. Please keep your login details private.
- Communicating with you: to provide customer support and keep in touch with you.
- Legal reasons: to comply with law or valid legal process, including requests from law enforcement or government agencies; to take part in litigation or other legal proceedings; and to enforce our terms and policies.
How We Disclose Personal Information
We may disclose personal information in these circumstances:
-
With Shopify and our service providers, who perform services for us. These include:
- payment processing
- age verification (AgeChecker.Net)
- email and text marketing (Omnisend)
- subscriptions (Appstle Subscriptions)
- rewards (Smile.io)
- reviews (Judge.me)
- optional shipping protection (Route)
- fulfillment and shipping carriers
- analytics, customer support and cloud storage
- With business and marketing partners, to provide marketing services and show you ads. For example, we use Shopify to support personalized advertising with third-party services based on your activity across merchants and websites. These partners use your information under their own privacy notices. Depending on where you live, you may have the right to opt out of this. You can do so on our Your Privacy Choices page.
- When you direct us or consent, for example to ship your order, or when you use social media features or login integrations.
- With our affiliates within our corporate group.
- For business transactions and legal reasons: in connection with a merger, sale or bankruptcy; to comply with legal obligations, including subpoenas and warrants; to enforce our terms; and to protect the Services, our rights and the rights of others.
Age Verification
We sell products only to adults 21 and older. At checkout, AgeChecker.Net verifies your age using your name, address and date of birth. If it can’t verify you automatically, you may be asked to upload a photo of your ID. AgeChecker processes this information under its own privacy policy. We keep the verification result with your order records. We don’t use your ID for marketing, and we don’t sell it.
Subscriptions
If you buy a subscription, Appstle Subscriptions manages your plan, billing schedule and customer portal for us. Appstle processes your name, email, shipping address, subscription products, frequency, order history and subscription status. Our payment processor stores your payment method and charges it for each delivery until you cancel or the plan ends. You can manage or cancel your subscription through the portal linked in your order emails or account.
Rewards and Reviews
If you join our Rewards Program, Smile.io tracks your points, rewards and referrals for us. If you post a review, Judge.me collects it for us. Your review, rating, photos and the name you provide (usually your first name and last initial) may be shown publicly on the Services.
Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your use of the Services in order to provide and improve them. Information you submit is shared with Shopify and with third parties that may be located outside the country where you live. We also use certain Shopify enhanced features that use data from your interactions with our store, with other merchants and with Shopify. For these features, Shopify is responsible for the processing, including for responding to your requests to exercise your rights. To learn more, see the Shopify Consumer Privacy Policy. You can exercise certain rights through the Shopify Privacy Portal.
Third-Party Websites and Links
The Services may link to websites or platforms run by third parties. We don’t control them and aren’t responsible for their privacy or security practices, so please review their policies. Information you share in public places, including on social media, may be visible to others. A link from our site does not mean we endorse that site.
Children’s Data
The Services are only for adults 21 and older. We do not knowingly collect personal information from anyone under 21. If you believe someone under 21 has given us personal information, contact us and we will delete it.
We do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) the personal information of anyone under 16.
Security and Retention
No security measures are perfect, and we can’t guarantee complete security. Information you send us may not be secure in transit, so please don’t send sensitive information through unsecure channels.
How long we keep personal information depends on why we need it: for example, to maintain your account, provide the Services, manage a subscription or rewards balance, comply with legal obligations, resolve disputes or enforce our policies.
Your Rights and Choices
Depending on where you live, you may have some or all of the rights below. These rights are not absolute, and we may decline a request as permitted by law.
- Access / Know: request access to the personal information we hold about you.
- Delete: request that we delete your personal information.
- Correct: request that we correct inaccurate personal information.
- Portability: receive a copy of your personal information and ask us to transfer it to a third party, in certain circumstances.
- Opt out of sale, sharing or targeted advertising: opt out of the “sale” or “sharing” of your personal information, or its use for “targeted advertising,” as defined by applicable law. You can do this on our Your Privacy Choices page. If you visit with the Global Privacy Control signal turned on, we will treat it as an opt-out request for that browser and device, depending on where you are. If we can link the device to a Shopify account, we’ll apply the opt-out to that account too. Learn more at https://globalprivacycontrol.org/. We do not respond to other “Do Not Track” signals.
- Communication preferences: you can unsubscribe from marketing emails at any time using the link in any email, and from texts by replying STOP. We may still send you non-marketing messages about your account, orders or subscriptions.
To use these rights, use the options on the Services or contact us using the details below. To learn about rights related to data processed by Shopify, visit https://privacy.shopify.com/en.
We will not discriminate against you for exercising your rights. We may need to verify your identity before we act on a request. You may use an authorized agent to make a request for you. If you do, we’ll ask the agent for proof that you authorized them, and we may ask you to verify your identity with us directly. We will respond within the time required by law.
Complaints
If you have a complaint about how we process your personal information, contact us. Depending on where you live, you may be able to appeal our decision by contacting us, or file a complaint with your local data protection authority.
International Transfers
We may transfer, store and process your personal information outside the country where you live. If we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses (or the UK equivalent), unless the transfer is to a country found to provide adequate protection.
Text Message (SMS/MMS) Program
If you sign up for texts, we use your phone number and the information you provide only to send you messages and respond to you. We share it only with the platform providers, phone carriers and other vendors that help deliver those messages. We do not sell, rent, trade or share phone numbers or opt-in information collected through our text program with third parties for their own marketing.
We may disclose information when necessary to comply with law, regulation or a government request, or to protect our rights or property. When you sign up, you agree to give accurate information under a name you’re authorized to use. We may refuse access to the program if we believe the information you gave is false or incomplete.
California residents may request information about our disclosure of personal information to third parties for their direct marketing purposes under California Civil Code Section 1798.83. To make a request, contact us using the details below.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal or regulatory reasons. We’ll post the updated policy here, change the “Last updated” date, and give any other notice the law requires.
