Can You Travel with Delta-8 THC?

It’s time for your big vacation or your much-deserved weekend getaway. Your bags are packed; you’ve got a full tank in the car, or your plane tickets are ready and waiting. Then, you glance at your Delta-8. Can you travel with Delta-8 THC? Will your edibles, vape cartridges or disposables be coming ith you?

Since it’s federally legal, Delta-8 THC is available in almost any state you live in or visit. Does that mean you should take it with you outside of your home? Can you travel with Delta-8 THC, and is there anything you should know before you do? These are very important questions, and we’re here to fill you in on the details in this guide.

IS IT LEGAL TO TRAVEL WITH DELTA-8?

Presently, there’s not a set-in-stone answer here. There are local laws in some areas that ban the use and sale of Delta-8 THC. You’ll need to keep a careful eye of that. It also depends on if you’re traveling by air or just using a car. Depending on your state’s laws, traveling with Delta-8 may present challenges.

Delta-8 is becoming more popular by the day; and it may be inevitable that you find yourself traveling with it at some point. Just think about how much better your getaway would be with some gummies or a disposable in hand. Prepare yourself to do just that! There are a few key things to keep in mind if you do plan on traveling with Delta-8.

If you’re traveling by car, this is where it gets tricky. The laws for cannabis products, hemp-derived or otherwise, vary vastly from state to state. If you’re traveling by car across state lines with any hemp product, make sure you’re crossing into a state where Delta-8 is legal. Otherwise, you may find yourself in trouble with authorities should they ever find out you are in possession of THC.

Fortunately, there is an easy way to avoid this altogether. Study up on the laws in any states that you’ll be traveling to. Then, double-check the THC content of all the products you’re taking with you. Do they contain less than 0.3% Delta-9 THC? If so, you’re good to go.

IS IT LEGAL TO FLY WITH DELTA-8?

IS IT LEGAL TO FLY WITH DELTA-8?

The rules on flying with Delta-8 may be even more ambiguous than flying with CBD. An uphill battle since the 2018 Farm Bill, it seems that it can come down to the airline’s discretion. In some instances, it may boil down to the TSA agent at the time.

In fact, the Transportation and Security Administration (TSA) amended their policy in 2019 to allow passengers to travel with hemp-derived CBD. The TSA website specifies their role – which is to search for weapons, not drugs – illegal or otherwise.

If, for any reason, the TSA agent considers your Delta-8 product as dangerous, suspicious, or illegal, they’ll give the product(s) to airport security. This team is usually a part of the local police force, and they can decide further action from there.

Maybe the TSA officer is having a bad day and makes you go through all of this. Fortunately, you probably will not be arrested. While the police test your Delta-8 product, you may be questioned, but that’s about it.

To avoid this delicate situation, simply ensure that your Delta-8 product contains less than 0.3% Delta-9 THC. Purchase your Delta-8 products through a trustworthy brand that tests each batch through a third-party lab. A clear indicator is if they have a lab reports section on their website.

FLYING DOMESTIC USA WITH DELTA-8

Remember, it’s legal to fly with Delta-8 in MOST states. The TSA will not be actively looking for Delta-8 to confiscate but nevertheless, you’ll still need to be wary should you choose to bring your favorite Eighty Six Group products with you on the flight.

Likewise, there are at least sixteen states that outright ban Delta-8. It’s more likely that it’s illegal to travel with Delta-8 if your destination are the following:

  • Alaska
  • Arizona
  • Arkansas
  • Colorado
  • Delaware
  • Kentucky
  • Idaho
  • Iowa
  • Mississippi
  • Montana
  • New York
  • North Dakota
  • Rhode Island
  • Texas
  • Utah
  • Vermont
  • Washington

Not traveling to any of these states? You might be in the clear. Triple-check the local laws and get ready to enjoy being stoned at your destination – and maybe even on the way!

Even if you are traveling to one of these states, there might still be a chance! Ask your airline if you can carry cannabinoids with you on your trip – plain and easy. If it’s a no, it’s a no, and you can act from there. If it’s a yes, it’s better they found out in advance. Now you can avoid getting in any trouble, experiencing delays, and pass on the questioning.

Again, the TSA isn’t after your Delta-8 products. They’re not looking for contraband or substances – they’re looking for weapons and ill intent. Passenger safety is their priority – not your pack of SUGAR edibles.

FLYING INTERNATIONALLY WITH DELTA-8

Alright, flying internationally with Delta-8 THC is a completely different game. The stigma for marijuana is bad in some areas in the U.S. And there’s a negative stigma for all cannabis – hemp and marijuana – across many other nations of the world.

In some countries, there are stringent and severe laws for carry such contraband on a flight. Depending on the country, you don’t want to be caught with any type of illegal substances.

Take some time to do your research before you embark to your destination. Sometimes, certain cannabis products may be legal in a country, but it’s still illegal to enter with those products.

Each country has its own laws on cannabis, with some similar to our “less than 0.3% delta-9” hemp rule. Other countries, like the European Union, call for even less of a presence of Delta-9 – 0.2% or less.

Realistically, if you’re flying internationally, it’s best to leave your Delta-8 at home. You may find that the cannabis products in that country are a great way to enjoy yourself while you’re there.

WHERE TO STORE DELTA-8 DURING THE FLIGHT

How can you travel with Delta-8 THC? It depends, of course, on the product in question. Where should you pack it, and how?

DELTA-8 VAPE CARTRIDGES OR DISPOSABLES

Vaporizers may be more difficult to travel with than edibles. Around the world, there’s a harsher stigma against vaping versus other cannabis products that can most likely pass as a regular product than a vape would. Most airlines, however, generally allow e-cigarettes that are battery-powered or electronic. They’re only allows as carry-on items most of the time, with Delta-8 distillates also falling into this category.

We hate to sound like a nag, but it may also be best if you ask your airline about it. It doesn’t hurt to be safe than sorry because there’s always that overly strict airline that can say no.

Likewise, don’t vape on the plane. Not only is it not exactly discreet, but it’s safer to pack it where it won’t get destroyed. Imagine scrambling for a puff and stuffing it back in a bag only to later find it leaking everywhere. Wait until after the plane lands and you leave the airport before switching your device on. If you get worried while flying, make sure to get your puffs in before you board.

DELTA-8 GUMMIES & OTHER EDIBLES

Discreet in nature, it’s rarely against the rules to carry on gummies, chocolates, or other foods. All it takes is a quick question with your airline to confirm if food is allowed. Plus, these types of Delta-8 edibles can be especially sensitive heat. Two ways to prevent melting is to carry them on with you and keep them in their original, sealed packaging.

It’s also much easier to pop a gummy or take a bite of chocolate than it is to vape on a plane. Would anyone even really know it contains cannabinoids from hemp? If you have severe flight worry, Delta-8 edibles might be the perfect solution.
